1.1. We are HomeIQ LLC., a Wyoming company ("HomeIQ", "our," "us," or "we") and we do respect your privacy and do our best to protect it. In that regard, we have drafted this Privacy Policy to inform you what exact personal data (personal data or personal information) we collect when you visit the website https://homeiq.io/ (the "Website") and/or use our proprietary home repair estimate engine and/or other services offered via our Website.
1.2. This Privacy Policy describes the information that we gather from you, how we use and store your information, whom we share your information with, and the steps we take to protect your information. Using our Website, you consent to the privacy practices described in this Policy.
1.3. Privacy Policy contains disclosures required by the California Consumer Privacy Act (“CCPA”) and applies only to “personal information” that is subject to that law. If you are a California resident, CCPA may apply to you when you use our Website and available services as they relate to business products featured on our Website. We generally use General Data Protection Regulation (“GDPR”) as a legal basis for conducting our Privacy Policy while doing business. This Privacy Policy should be read in conjunction with the HomeIQ Terms of Use, which are incorporated herein by reference.
1.4. Our Website is not intended for children under the age of 18. Noone under the age of 18 may provide any information to or on the Website. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Website or through any of its features, make any purchases, actions or transactions with the help of our Website or provide any information about yourself to us. If we learn we have collected or received personal information from a child under the age of 18 without verification of parental consent, we will delete that information promptly. 2. What categories of data does HomeIQ collect?
2.1. Personal data. We collect, use, store and transfer different kinds of Personal data about you. “Personal data” means any information, including cookies, that may be used to identify, describe or be reasonably linked to an individual. We may ask you to provide Personal data that will enable us to enhance your use of the Website, for purposes such as facilitating correspondence with you, registering your entitlement to access certain special features or to transfer your request to our Partner. It is always your choice whether to provide or not to provide that Personal data. If you choose not to provide requested Personal data, you may not be able to use certain features of the Website.

We represent and warrant that, at all times, we will comply with all applicable state and federal laws, rules and Federal Trade Commission enabling regulations (including the CAN-SPAM Act of 2003, as amended from time to time) and any other applicable laws. We make every effort to ensure that all our partners and counterparties act in the same way, however, we cannot fully vouch for them. If you have received spam and there is good reason to believe that it was sent by our partners, please let us know about that case and try unsubscribing (opt-out from the message).
When you provide us your telephone number and email, you provide your consent to obtain emails and call from us or from our partners - service providers, to obtain commercial information - advertisements provided by us or our partners via SMS/text message (“SMS”) and this means that you provided “prior express written consent,” as defined in the Telephone Consumer Protection Act, 47 U.S.C. §§ 227 et seq., all implementing regulations (47 C.F.R. § 64.1200 (f)(8)), and all applicable FCC rulings and orders (collectively, the “TCPA”) to receive SMS from us, by and on behalf of us or from our partners.
We will perform all of our activities, obligations and responsibilities contemplated hereunder in compliance with all applicable laws, rules and regulations, including but not limited to the TCPA, the Telemarketing Sales Rule (“TSR”) all Do Not Call (“DNC”) rules. We respect all suppression lists. But please, note that if you provide your telephone number, you can receive a call from our partners. If you disagree with this, please, do not provide your telephone number.
3.2. We may change this Privacy Policy by posting a new version of this Privacy Policy on our Website or through the Service, and it is your responsibility to review this Policy periodically. When we do change the Policy, we will also revise the "Revised" date and may notify you or post a message on the Website and/or through the Service. Your continued use of the Website or the Service constitutes your agreement to this Privacy Policy and any updates to it.

4.1.9. lodge a complaint with your national supervisory authority (in the EEA) if you believe that your privacy rights have been violated (Art. 13(2)(d), 14(2)(e), 15(1)(f) GDPR);
4.1.10. If you are a California resident, you can request to receive certain information about the personal data we have collected about you in the last 12 months. You may make such a request no more than 2 times within a 12-month period (CCPA).
4.2. To exercise these rights, please contact us as indicated in this Privacy Policy's ‘How To Contact Us’ section. If you are a California resident, please consult the section 5 below for more information about your rights. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. To the extent permitted by applicable law, a charge may apply before we provide you with a copy of any of your Personal data that we maintain.
5. Special Notice For California Residents.
5.1. If you are a California resident, then you have certain rights under the California Consumer Privacy Act ("CCPA”) regarding your Personal data:

5.1.2.. Deletion Request Rights. You have the right to request us to delete any of your Personal data that we collected from you and retained, subject to certain exceptions provided by law.
5.2. To exercise your access or deletion request rights, please submit a verifiable consumer request to us as indicated in the ‘How To Contact Us’ section of this Privacy Policy.
5.3. Only you or someone legally authorized to act on your behalf may make a verifiable consumer request related to your Personal data. You may only make a verifiable consumer request for access twice within a 12-month period. The verifiable consumer request must:
5.3.1. Provide sufficient information that allows us to reasonably verify you as the person about whom we collected Personal data or an authorized representative of such a person.
5.3.2. Describe your request with sufficient detail that allows us to understand, evaluate and respond to it properly. We cannot respond to your request or provide you with Personal data if we cannot verify your identity or authority to make the request and confirm that Personal data relates to you.
5.4. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
5.4.1. deny you goods or services;
5.4.2. charge you different prices or rates for goods or services;
5.4.3. provide you a different level or quality of goods or services;
5.5. We also plan to introduce new opportunities for the implementation of the rights of users - residents of California after the entry into force California Privacy Rights Act (CPRA), which introduces four California consumer privacy rights that are not present in the CCPA:
5.5.1. Right to Correct Information: User has the right to request HomeIQ to correct any inaccurate personal information.
5.5.2. Right to Limit the Use and Disclosure of Personal Information: User has the right to limit the use and disclosure of their personal data to that “use which is necessary to perform the services or provide the goods reasonably expected by an average User who requests such goods and services’.
5.5.3. Right to Access Information About Automated Decision Making: User has the right to request “meaningful information about the logic involved in those decision–making processes, as well as a description of the likely outcome of the process concerning the consumer (if any).”
5.5.4. Right to Opt–Out of Automated Decision-Making Technology: User has the right to opt–out of being subject to automated decision–making processes, including profiling.
5.6. We do not sell personal information to third parties for monetary value. However, the term "sale" is broadly defined under the California Consumer Privacy Act. To the extent that a "sale" under the CCPA is interpreted to include interest-based advertising, we will comply with applicable law in relation to that activity. To opt out of receiving interest-based advertising, you can make your choice by directly writing to us about it. California law gives residents the right to request a notice describing the categories of personal information we share with third parties for their own direct marketing purposes. We may share your data with third parties for marketing purposes according to your interests, which we understand based on your use of our services. If you do not agree to this, please ask us not to do so and we will not share any personal information with third parties for their own direct marketing purposes. 6. Information for New York, Colorado, Nevada, Virginia and other states Residents
US state privacy regulations provide New York, Colorado, Nevada, and Virginia residents with specific rights regarding their personal information. If you are a resident of the mentioned state, for more information, please see the NY Privacy act (NYPA), Colorado Privacy Rights Act, Nevada Privacy Law (NPICICA) and Amendment SB-220 and Virginia Consumer Data Protection Act and find the appropriate part of this section that applies to you:
6.1. New York Privacy Act (NYPA):
Home IQ makes all necessary efforts to be compliant with NYPA, tries to keep reasonably secure personal data from unauthorized access and will promptly notify consumers (User) of a breach (if any). HomeIQ will not use your personal data in a way that
(i) benefits an online service providers to the detriment of you;
(ii) would result in reasonably foreseeable physical or financial harm to you; or
(iii) would be unexpected and highly offensive to you.
The NYPA provides consumers a broad set of rights over their personal data.
If you are a NY state resident, your rights include:
Right to notice – by posting this Policy we made publicly and consistently available a notice to you containing: (i) a description of the your rights (ii) the categories of personal data processed by us; (iii) the sources from which personal data is collected; (iv) the purposes for processing personal data; (v) the categories of third parties to whom we disclosed, shared, transferred your personal data (vi) retention period for personal data that we process.
Right to opt out - means the right to opt out, at any time, of processing your personal data concerning : (i) targeted advertising; (ii) the sale of personal data; and (iii) profiling in furtherance of decisions that produce legal or similarly significant effects on you.
Right to access - upon your verified request we will: (a) confirm whether or not we are processing or have processed personal data, and provide access to a copy of any such personal data; and (b) provide the category of each processor or third party to whom we disclosed, transferred your personal data.
Right to portable data - upon your verified request, and to the extent technically feasible, we will: (a) provide you copy of all of, or a portion of, as designated in a verified request, personal data in a structured, commonly used and machine-readable format and (b) transmit the data to another person of your designation.
Right to correct - upon your verified request we will conduct a reasonable investigation to determine whether personal data, the accuracy of which is disputed by you, is inaccurate. If personal data is found to be inaccurate or incomplete, or cannot be verified, we will correct the inaccurate or incomplete personal data.
Right to delete - upon your verified request we will: (i) within 45 days after receiving the request, delete any or all of your personal data. That period may be extended once by 45 additional days where reasonably necessary, taking into account the complexity and number of the requests. We will inform you of any such extension within 45 days of receipt of the request, together with the reasons for the delay.
6.2. The Colorado Privacy Act (CPA) protects the privacy rights of Colorado residents.
If you are a Colorado resident, you have set of rights over your personal data:
Right of access - the right to confirm whether we are processing your personal data and to access that data.
Right to correction - the right to correct inaccuracies in your personal data.
Right to deletion - the right to ask for deletion of your personal data.
Right to data portability - up to two (2) times per calendar year, you have the right to obtain your personal data in a portable and readily usable format that allows you to transmit the data to another entity without hindrance.
Right to Opt-Out - you may opt out of the processing of your personal data for:
(i) targeted advertising;
(ii) the sale of personal data;
(iii) profiling.

If you have any questions or concerns, please contact us with your request. We will have 45 days to fulfill User`s request (which may be extended another 45 days where reasonably necessary).
6.3. Nevada Privacy Law primarily focuses on your opt-out rights regarding sellingthe sale of your personal information.
If you want to opt-out, please complete a form on our website to submit a request to opt-out of the sale of your personal information under Nevada Privacy Law (NPICICA) and Amendment SB-220. We will respond immediately for verification, and as soon as possible with confirmation that your request has been completed.
We will respond to your verified request within 60 days after receipt, which may be extended up to 30 days if reasonably necessary. We will notify you of the reasons for the extension.
6.4. Virginia Consumer Data Protection Act (VCDPA)
If you are a Virginia resident, you have the following rights specified in the VCDPA:
Right to confirm whether we are processing your personal data;
Right to access the personal data processed by us;
Right to correct inaccuracies in your personal data;
Right to delete personal data provided by or obtained about you;

HomeIQ will not process your personal data for any purpose from which the User has opted out.
You may opt out of the processing of your personal data for:
(i) targeted advertising - displaying advertisements to you where the advertisement is selected based on personal data obtained from your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests.
(ii) the sale of personal data - the exchange of personal data for our monetary consideration to a third party.
(iii) profiling - in further of decisions that produce legal or similarly significant effects (provision or denial of financial, lending, housing, insurance, education, criminal justice, employment, healthcare, or essential goods or services) - any form of automated processing performed on personal data to evaluate, analyze, or predict personal aspects related to an identified or identifiable natural person’s economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. You have the right to opt out of profiling.
HomeIQ allows Users to opt out of the sale, profiling or sharing of personal information, including sharing personal information for the purpose of cross-context behavioral advertising (also known as “targeted advertising”).

We also want to emphasize that HomeIQ cares about the privacy of its Users. We have listed some of the states whose residents are eligible to opt-out. However, if you are a resident of another state or territory not listed in this Policy but your local privacy law gives you the right to opt-out, you are guaranteed to be able to use it in the same form specified above.
7. How does HomeIQ receive your Personal data?
7.1. The information we hold about you may be collected from you directly or through our interactions with you (for example, if you contact our support team or submit a request or complaint to us). Information about you may also be collected automatically. Such Personal data includes Identity data, Contact details, Technical details which you give us (i) by using our Website and by communicating with us by email or post, or by speaking to us in person or over the telephone.

Our Website is designed in such a way that we do not provide repair services ourselves. We only act as a matching platform between the user and our Partners - organizations or individuals that can directly provide the service you need.
Please note that when filling out an application for a particular service, you provide us with your personal data, which will then be available to the relevant Partner to contact you. Also, your data may be transferred to other third parties - advertisers, to provide you with advertising materials in the future, according to your interests.
9.1. We may disclose your information in connection with providing you with the access to the Website and the operation of our business. For example, we may share personal information, such as name, email, address and other identifying information with nonaffiliated Partners to verify your identity in connection with your use of certain aspects of the services available through the Website.
9.2. HomeIQ may share Personal data it collects about you to or with third parties, including our Partners, but only if we believe based upon your actions (including your actions and submissions via our Website) that you intend to interact with such Partner through your use of our Service.
9.3. HomeIQ does not sell your Personal information to our Partners or other third parties.
9.4. We may share your information with third-party service-providers to support our internal and business operations. In such cases, service-providers may use the information only as necessary to provide the services to us and are contractually required to keep your information confidential and secure. For example:

HomeIQ has no control over the rules the third parties further use or disclose your information.

You may also receive telemarketing calls as a result of submitting the request, If you do not want us or our Partners to call you, please, do not provide your telephone number.
9.10. Do not submit a request for information or services if you do not want your personal information shared as described above. Once you have submitted a request through the Website and we have shared your information as described above, the terms of the third party’s privacy policy will apply to that party’s use of your Personal data. You may decline to share certain information with us, in which case we may not be able to provide to you some of the features and functionality of the Website.
